S-13-0063, Adam Liljestrand v. Dell Enterprises, Inc. d/b/a The Dundee Dell (Appellant)

Nebraska Workers’ Compensation Court

Attorneys: Ronald E. Frank, Harry A. Hoch, III (Sodoro Daly Shomaker & Selde PCLLO) --- Thomas M. Locher, Joseph J. Kehm, Robert H. Grennan (Locher Pavelka Dostal Braddy & Hammes LLC) (for Appellant)

Civil: Workers’ Compensation

Proceedings below: This case was previously in the Court of Appeals. See Liljestrand v. Dell Enterprises, A-11-0925 (Affirmed, memorandum opinion). The previous appeal affirmed the finding of the 3-judge review panel that ordered the case be remanded back to the trial court for further findings. Upon remand, the trial court entered an award on mandate after reviewing the transcript and bill of exceptions from the original trial. Appellant filed a Petition to Bypass the Court of Appeals which was granted by the Nebraska Supreme Court.

Issues: The workers’ compensation court erred in (1) failing to conduct a new trial or abide by any other procedural due process; (2) finding that Appellee is permanently and totally disabled.
