A-13-0022, Nautilus Insurance Company v. Cheran Investments, LLC, Pinnacle Bank, Michael Perkins d/b/a Perkins & Perkins Co., and Blasini Inc. and Richard Bruno d/b/a Bruno Investments (Appellant)

Douglas County, District Judge Joseph Troia

Attorney for Appellant:  Ryan J. Lewis (Lewis, Pfanstiel & Reed, LLC)

Attorneys for Appellee:  Craig A. Knickerehm and Jonathan M. Brown (Walentine, O’Toole, McQuillan & Gordon, LLP)

Civil Action:  Distribution of insurance proceeds

Action Taken by Trial Court: The district court found that because Blasini failed to pay money owed under a purchase agreement, Cheran retained title and ownership of the property subject to a security interest of Pinnacle Bank. The district court found Pinnacle Bank was the proper payee of the insurance proceeds and granted the Bank’s motion for summary judgment.

Assignments of Error on Appeal:  The Appellant assigns that the district court erred in granting Pinnacle Bank’s motion for summary judgment due to failure to consummate the purchase agreement.
