Proceedings Below: The district court granted summary judgment on William Coffey’s claims of breach of good faith and fair dealing and breach of contract on failure to pay commissions on projects known as the First Date Recurring Billing Project and as Argentina, B-24.

Issues: 1. The Court erred in sustaining the Appellee's Motion for Summary Judgment as to the claim for payments on the First Data project. 2. The Court erred in sustaining Appellee's Motion for Summary Judgment as to additional payments owed on the Posnet Project. 3. The Court erred in sustaining Appellee's Motion for Summary Judgment as to the claim of a breach of the implied covenant of good faith and fair dealing. 4. The Court erred in determining that there can be no claim for breach of covenant of good faith and fair dealing under Nebraska law. 5. The Court erred in defining "orders on file" as an executed contract rather than submitting the issue to the jury. 6. The Court erred in partially sustaining Appellee's Motion for Summary Judgment.  7. The Court erred in denying the Motion to Alter or Amend the Judgment filed by Appellant and reconsidering its ruling.
