A-13-0461, In re Interest of Laticia S.

Douglas County, Juvenile Judge Elizabeth G. Crnkovich

Attorney for Appellant Mother:  Jane M. McNeil (McNeil Law Office)

Attorney for Appellee/Cross-Appellant Father: Rita L. Melgares

Attorney for Appellee:  Sarah Graham (County Attorney’s Office)

Juvenile Action:  Adjudication; Educational Neglect

Action Taken by Trial Court: The trial court adjudicated Laticia under Neb. Rev. Stat. § 43-247(3)(a) due to the fault of her parents for neglecting her education. The trial court found that reasonable efforts were made to prevent removal and placed Laticia in the temporary custody of DHHS.

Assignments of Error on Appeal:  The mother did not specifically assign errors in her brief on appeal.

Assignments of Error on Cross-Appeal:  The father assigns that the juvenile court erred in determining that: (1) he had failed or refused to provide proper or necessary subsistence, education, or other care necessary for the health, morals, or well-being of the minor child; and (2) reasonable efforts were provided by the school to cure deficiencies leading to the alleged insufficient subsistence, education, or other care necessary for the health, morals or well-being of the minor child.
