Civil: DNA Testing

Proceedings below: The Supreme Court affirmed Appellant’s conviction and life sentence. See State v. Young, 279 Neb. 602 (2010). The Supreme Court also considered a subsequent appeal, State v. Young, S-12-0123 (Suggestion of Remand granted, matter remanded to trial court to rule on Young’s motion for leave to amend request for DNA testing). Upon remand, the trial court held a hearing on the matter and thereafter denied Appellant’s Amended Motion for DNA Testing.

Issues: The district court erred in denying Appellant’s request for DNA testing of the black shirt and shell casings found at the scene of the shooting.
