Criminal Action: Possession of Marijuana with Intent to Deliver, Possession of Marijuana Weighing More Than One Pound, Possession of Marijuana Without Tax Stamps

Action Taken by Trial Court:  The trial court denied Fioramonti’s motion to dismiss on speedy trial grounds, finding that the motion was premature.

Assignments of Error on Appeal:  Fioramonti alleges the district court erred in finding that (1) Fioramonti’s discovery motion tolled the speedy trial clock, and (2) less than 6 months had elapsed since the information was filed.
