Douglas County, Judge Duane Dougherty

Attorneys: George R. Love (Attorney General’s Office) --- Thomas Riley (Public Defender’s Office) (Appellant)

Criminal: Sexual Assault by Use of an Electronic Device, Class ID Felony; Child Abuse, a Class IIIA Felony

Proceedings below: Appellant was found guilty by a jury of the above crimes. He was sentenced to consecutive sentences of 8 to 12 years and 1 to 2 years respectively.

Issues: (1) The trial court erred in joining all offenses into a single trial. (2) The subpoenas issued by the State were not authorized and do not comply with Nebraska law.
