Civil: This is a declaratory judgment action under § 84-911 of the APA to challenge the validity of a DCS regulation that limits inmates’ access to the law library to one hour per day.

Proceedings below: The court granted the Department’s motion for summary judgment, denied Payne’s motion, and dismissed Payne’s complaint with prejudice.  

Issues: Whether the court erred in (1) applying a federal standing standard for Payne’s state law claim and (2) determining that the Department was entitled to judgment as a matter of law.
