Proceedings below: The juvenile court adjudicated Appellant under Neb. Rev. Stat. §43-247(3)(b).

Issues: 1) The juvenile court erred in failing to distinguish habitual truancy from excessive absenteeism, 2) the juvenile court’s interpretation of Neb. Rev. Stat. §43-247(3)(b) creates an improper and unconstitutional delegation of legislative power to school authorities, and 3) the juvenile court lacked sufficient evidence to establish a finding of habitual truancy.
