Civil Action:  Contract Action/Settlement Agreement

 

Action Taken by Trial Court:  The district court for Buffalo County found that the parties’ settlement agreement was an enforceable contract and ordered the parties to comply with the terms and conditions of the settlement agreement within 30 days.

 

Assignments of Error on Appeal:  Sea-Hubbert Farms claims that the district court erred when it 1) found that there was an enforceable settlement agreement; 2) afforded general provision controlling authority over a specific condition of the agreement; 3) found Clarice Boston was obligated to select a plan most beneficial to her that has not been obstructed by the appellee; and 4) found that the settlement agreement provided that the appellants would cooperate in the development of a plan, but that a plan be accepted by Clarice Boston before the settlement agreement was effected.
