Assignments of Error on Appeal: Aguirre alleges the district court erred in (1) finding that his FELA claim and the negligence claim in this action were based on the same cause of action, (2) finding that the order of dismissal was a judgment “on the merits” for purposes of res judicata, and (3) dismissing his claim based on res judicata where his filing of the FELA action was a mistake as to the proper remedy for his claim.
