S-12-0794, Cynthia Rae Caniglia (Appellant) v. Jason Arthur Caniglia (Appellee)

Sarpy County, Judge William B. Zastera

Attorneys:       Margaret M. Zarbano (Appellant) --- Kristina B. Murphree and Steven J. Riekes (Appellee) (Marks Clare & Richards, L.L.C.)

Civil:   Child support

Proceedings Below:  The district court modified the parties’ divorce decree due to Jason’s changed circumstances.  The court reduced his child support obligation and childcare contribution percentage, and also modified the Neb. Rev. Stat. § 42-364.17 “out of pocket” provision of the decree to require Jason’s consent to hold him responsible for additional expenses under that provision.

Issues on Appeal:  Cynthia assigns that the court erred in (1) finding a change of circumstances warranting a reduction in Jason’s child support obligation from $722 to $375 per month and his childcare contribution percentage from 50% to 36%; and (2) modifying the “out of pocket” provision in the decree to require Jason’s consent to hold him responsible for additional expenses under that provision.
