S-13-0218, In re Interest of Danaisha W. et al.

Separate Juvenile Court for Lancaster County, Judge Linda S. Porter

Attorneys: Hazel Rodriguez (Legal Aid of NE) (for Appellant Dennisca W.) --- Carolyn Bosn (County Attorney’s Office)

Civil: Visitation order

Proceedings below: The trial court suspended visitation between Appellant and the minor children but in the order, set forth specific terms Appellant could abide by in order for supervised visitation to occur.

Issues: The court erred in (1) delegating it’s authority to DHHS and therapists to enforce conditions for visitation; (2) finding that visitation with the children shall be separate contrary to the best interests of the children and despite Appellant’s progress and improvement; (3) creating in part a conditional order which is unreasonable and wholly void.
