S-13-0264, In re Interest of Samantha L.

Separate Juvenile Court for Douglas County, Judge Vernon Daniels

Attorneys: Matthew P. Saathoff (Saathoff Law Group) (Appellant William H., father) --- Molly Adair-Peterson (for Kelly L., mother) --- Shakil Malik (Deputy County Attorney for the State)

Civil: Change in permanency plan for minor child

Proceedings below: This case was previously before the Supreme Court. See In re Interest of Samantha L., 284 Neb. 856 (2012) (vacated and remanded for further proceedings). Upon remand, the trial court held a hearing and determined the permanency objective for Samantha L. shall be changed to guardianship with a concurrent plan of adoption and reasonable efforts in support of reunification were no longer required.

Issues: The juvenile court erred in (1) finding that reasonable efforts in support of reunification were not required; (2) failing to order a permanency hearing within 30 days of the February 22, 2013 hearing date; (3) ordering that the permanency objective be guardianship with a concurrent plan of adoption.
