S-13-0122, Justin S. Furstenfeld (appellant) v. Lisa B. Pepin (appellee)

Lancaster County, Hon. John A. Colborn

Attorneys:  Matt Catlett (appellant); Terrance A. Poppe and Benjamin D. Kramer (Morrow, Poppe, Watermeier & Lonowski) (appellee)

Civil:  dissolution of marriage; custody modification

Proceedings below:  After a hearing, the district court for Lancaster County entered an order granting Lisa Pepin’s, the appellee, motion, and ordered that Justin Furstenfeld, the appellant, sign a waiver or a release for his medical records, which were to be delivered to Furstenfeld’s attorney, who would then forward them to Pepin’s attorney. Furstenfeld appeals.

Issues: Furstenfeld that the district court erred when it ordered him to sign and deliver a waiver or a release to non-parties enabling such non-parties to release any medical records in their possession relating to Furstenfeld, with instructions to deliver any such records to Furtstenfeld’s attorney for subsequent production to Pepin’s attorney.
