Civil: concealed handgun permit

Proceedings Below: Underwood applied for a permit to carry a concealed handgun under the Concealed Handgun Permit Act, Neb. Rev. Stat. § 69-2427 et seq. The State Patrol denied that application, and Underwood appealed to the district court. The district court upheld the denial of the permit. Underwood again appeals.

Issue on Appeal: Whether Underwood's prior conviction for attempted third degree sexual assault of a child is a misdemeanor crime of violence which, under § 69-2433, would prevent him from obtaining a permit to carry a concealed handgun.
