Proceedings below: The Supreme Court affirmed Appellant’s conviction and sentence. See State v. Fester, 274 Neb. 786 (2008). Appellant filed the postconviction action and requested an evidentiary hearing. Following an evidentiary hearing, the district court denied postconviction relief.

Issues: The district court erred in denying Appellant’s verified Motion for Postconviction Relief as he was denied effective assistance of trial counsel that resulted in pleas that were not knowingly, intelligently and voluntarily entered.
