A-13-0331, In re Interest of Eli S., a child under 18 years of age. State of Nebraska v. Tammy S. (Appellant)

Lancaster County, Separate Juvenile Court Judge Reggie L. Ryder

Attorney for Appellant:  Brittani Lewit (Legal Aid of Nebraska)

Attorney for Appellee (State):  Alicia Henderson (County Attorney’s Office)

Attorney for Appellee (Guardian ad Litem):  Julianne Spatz

Juvenile Action:  Termination of parental rights

Action Taken by Trial Court:  The juvenile court found that grounds to terminate Tammy’s parental rights existed pursuant to Neb. Rev. Stat. § 43-292(2) (neglect of a sibling of Eli’s) and that termination was in Eli’s best interests.

Assignments of Error on Appeal:  Did the juvenile court err in finding that § 43-292(2) was met based on facts from a previous case and without considering Tammy’s present circumstances? Did the juvenile court err in finding that termination was in Eli’s best interests?
