A-13-0339, In re Interest of Joseph S., a child under 18 years of age. State of Nebraska (Appellant) v. Kerri S.

Douglas County, Separate Juvenile Court Judge Elizabeth Crnkovich

Attorney for Appellant:  Donald W. Kleine, Jennifer Chrystal-Clark (County Attorney’s Office)

Attorney for Appellee:  Thomas C. Riley, Christine D. Kellogg (Public Defender’s Office)

Attorney for Guardian Ad Litem:  Maureen K. Monahan

Civil Action:  Adjudication, Termination of Parental Rights

Action Taken by Trial Court:  The juvenile court found the children to be within the meaning of Neb. Rev. Stat. 43-247(3)(a), but found the children were not within the meaning of Neb. Rev. Stat. 43-292(2) for lack of clear and convincing evidence that it was in the best interests of the minor children to terminate the Appellee’s parental rights

Assignments of Error on Appeal:  Did the court err in finding termination was not warranted under Neb. Rev. Stat. 43-292(2)? Did the court err in finding Kerri did not continuously neglect to provide parental care and protection for the minor children? Did the court err in finding termination was not in the best interests of the minor children?
