District Judge Mark Kozisek Sits with Nebraska Supreme Court

Nebraska District Court Judge Mark D. Kozisek of Ainsworth, Nebraska, was invited to sit with the Nebraska Supreme Court on May 25, 2022.

Kozisek heard arguments in the case of Great Plains Livestock Consulting, Inc. v. Midwest Insurance Exchange, Inc. (S-21-0722).  When two (2) lawsuits were filed against Great Plains Livestock Consulting, Inc. (Great Plains), Great Plains brought a negligence action against Midwest Insurance Exchange, Inc. for their failure to obtain an errors and omissions insurance policy.  After hearing Motions for Summary Judgment, the district court dismissed the negligence action finding that the damages were speculative and not ripe as settlements had not yet been reached or judgments had not yet been entered. 

He sat in place of Justice Stephanie Stacy, who was recused from the case. The Court session was held in the Supreme Court Courtroom of the Nebraska State Capitol in Lincoln.

Seven justices make up the Nebraska Supreme Court: Chief Justice Mike Heavican and six associate justices. On occasion, a justice must recuse him or herself from a case, and a judge from a district court or the Court of Appeals is asked to sit with the Supreme Court.
