A-12-0491, In re Interest of Alexandria H., Jacob H, Madison H., Megan H., and Morgan H., children under 18 years of age. State of Nebraska v. Brett H. (Appellant)

Otoe County, County Court Judge Robert B. O’Neal

Attorney for Appellant:  Diane L. Merwin (Public Defender’s Office)

Attorney for Appellee:  Timothy S. Noerrlinger (County Attorney’s Office)

Juvenile Action:  Termination of Parental Rights

Action Taken by Trial Court:  The trial court terminated Appellant’s parental rights to his four minor children after finding that termination was warranted pursuant to Neb. Rev. Stat. § 43-292(2), (4), (6), and (7), and that termination was in the children’s best interests.

Assignments of Error on Appeal: On appeal, Appellant challenges the trial court’s determination that there was sufficient evidence to warrant termination of his parental rights and its finding that he is an unfit parent. Appellant also alleges that the trial court erred in allowing the State to amend its motion to terminate parental rights and in not recusing itself after demonstrating partiality in favor of the State.
