Case Summary

A-21-0209, Winfield Scott Copley, Jr. (Appellee) v. Advanced Services, Inc., and Corvel Insurance (Appellants)

Nebraska Workers’ Compensation Court, Judge Dirk V. Block

Attorney for Appellants: William Birkel (McGrath North)

Attorney for Appellee: Thomas A. Wagoner

Civil:  Workers’ Comp and determination of benefits for injured worker

Action Taken by Trial Court: The compensation court determined that Appellee had an accident in the course and scope of his employment with Appellants. As a result of this accident, Appellee incurred two injuries: one to his left biceps tendon and one to his left eye and face. The court found that Appellee’s injury to his left biceps tendon had reached maximum medical improvement and that he was entitled to permanent partial disability payments. However, the court also found that Appellee’s injury to his eye and face had not reached maximum medical improvement. The court awarded Appellee continuing temporary total disability payments until such time as his left eye and facial injuries had reached maximum medical improvement.

Assignments of Error on Appeal: On appeal, Appellants allege that the compensation court erred in (1) finding that Appellee’s work-related accident caused injury to his left eye and face; (2) awarding Appellee continuing temporary total disability payments rather than permanent partial disability payments; (3) finding that Appellees’ injury to his left biceps tendon resulted in permanent impairment: (4) failing to provide a well-reasoned opinion; and (5) overruling their motion for reconsideration or modification of the award.
