Case Summary

A-17-0350, Gonzales (Appellants) v. Nebraska Pediatric Practice, Inc.

Douglas County, District Court Judge James T. Gleason

Attorney for Appellants: Greg Garland (Greg Garland Law), Kathy Pate Knickrehm, and Tara DeCamp (Decamp Law, PC, LLO)

Attorney for Appellees: Patrick G. Vipond and Sarah M. Dempsey (Lamson, Dugan and Murray, LLP)

Civil Action: Medical Malpractice

Action Taken by Trial Court:  The district court granted a motion to strike testimony from appellants’ expert witness finding the testimony insufficient to prove causation and finding the expert generally unqualified to give an opinion on causation. Subsequently, finding no other evidence of causation, the court granted summary judgment in favor of the appellees.

Assignments of Error on Appeal:  Appellants assign, summarized and restated, that the district court erred by (1) excluding the causation opinion of the appellants’ expert witness; (2) admitting affidavits from appellees’ expert witnesses in support of appellees’ motion for summary judgment; and (3) granting appellees’ motion for summary judgment.
