Case Summary

A-16-0801, Tewes (Appellant)  v. Tewes

Douglas County, District Court Judge Thomas A. Otepka

Attorney for Appellant:  Brent M. Kuhn (Brent Kuhn Law)

Attorney for Appellee:  Virginia A. Albers, Hannah C. Wooldridge (Slowiaczek, Albers & Astley, P.C., L.L.O.)

Civil Action:  Motion to Interpret Dissolution Decree

Action Taken by Trial Court:  Ex-husband filed a motion to determine the intent of the dissolution decree and order on motion to compel. Following a trial, the district court ordered the ex-husband to pay his ex-wife $19,236.68.

Assignments of Error on Appeal:  On appeal, the ex-husband contends that the district court erred in (1) limiting operating expenses to “Schedule E” expenses as defined by the IRS; (2) in considering post-trial arguments which were not supported by evidence at trial in reaching its decision on the ultimate issue before the court; (3) failing to give proper weight to his expert’s testimony; (4) failing to adopt certain admissions against interest made by the ex-wife at trial; and (5) failing to interpret the dissolution decree based upon the intent of the parties.
